Family Law Fees.

TolTops Solicitors has a Legal Aid contract so we are able to offer Legal Aid to eligible individuals in relation to private or public family law cases.

Under current legislation, Legal Aid is available for public family law cases (such as Care proceedings) and in private family law cases (such as Divorce, Financial Remedy, and Children disputes) for victims of domestic abuse, or where there is a risk of child abuse (provided that the required evidence is obtained and subject to financial eligibility). It is also available for eligible individuals who are attending mediation and require legal advice during mediation or to draft a consent order following an agreement reached in mediation.

In relation to our privately paying clients, we are aware that relationship breakdown is a very difficult time both emotionally and financially and we make sure that we are open and upfront about our costs so that they know where they stand.

From the outset, we have a frank discussion with prospective clients to determine a package to suit their budget to ensure that they can have the benefit of legal advice, and representation throughout proceedings or restricted to certain key aspects of their case.

Our fee earners private hourly rates start at £100 plus VAT for paralegals, increasing to £250 plus VAT for our Partners. Whilst we ordinarily appear on behalf of our clients throughout their case, if you solely wish to have advice in relation to a certain aspect of your case, or at a certain stage in proceedings we will be happy to do this.

We try to offer fixed fees where possible, which also includes a phase by phase fixed fee on cases where we are conducting the case/representing throughout.

Drafting Form E- includes initial meeting £650
Drafting Children Act application- includes initial meeting £500
Drafting non-molestation order application and statement- includes initial meeting £500
Phase by Phase fixed fee for Contested Divorce – Fixed fee per phase £720
Phase by Phase fixed fee for Children disputes – fixed fee per phase £1200.00
Phase by Phase fixed fee for Financial Remedy disputes – fixed fee per phase £1800.00

 

If your case requires further work in addition to that included in the fixed fee, such as further meetings or correspondence then additional fees may apply at the fee earner’s hourly rate.
